Noor Saga-Failed Arbitration Part 1.
Who is to blame?
Before you read this posting, please read Noor Saga-Introduction, if you have not done that yet.
The Resolution Committee
Farag and the other three board members (later known as the disputed board members) wanted to mediate the issue with Saqr and tried involving a few people quietly for this effort. This did not work. Then, on advice from their attorney, they called for a meeting of about 35 people of the Noor community on October 4, 2009, including many respected elders. They invited Saqr and asked him to invite whomever he wanted. Saqr was at the Center during the meeting but did not attend. At this meeting a resolution committee was formed and comprised of Dr. Azeez Haque (Chairperson), Mohammed Amin, Jamal Mansour, Aneezal Mohamed, and Dr. Asma Mobin-Uddin.
The resolution committee was asked to address the following issue and report back to the larger group of community leaders:
"Review the By-Laws of American Islamic Waqf (“AIW”) and discuss with Saqr whether he would agree to binding arbitration by this committee on a finding of whether or not Ayoub, Mandourah, and Islam, are legitimate members of AIW Board."
The resolution committee reviewed the By-Laws of AIW and then met with Saqr, (and Amgad Saleh via conference call), on Sunday, October 25, 2009. The meeting lasted about 2.5 hours. Saqr agreed to abide by the decision of the resolution committee once Farag presented evidence supporting his position that Ayoub, Mandourah, and Islam were members of AIW Board. However, Saqr did not agree to unconditional binding arbitration.
The committee asked Farag, as requested by Saqr, to provide evidence supporting the position that Ayoub, Mandourah, and Islam were validly appointed members of AIW Board. Farag insisted that the committee should get a binding arbitration commitment from Saqr before he could provide any such evidence.
Being frustrated by the lack of progress and because the resolution committee was unable to secure a commitment to binding arbitration by Saqr, Hassan Ayoub wrote on 10/31/2009:
“We thank the brothers and sisters that formed the original arbitration committee however we have realized that these legal matters are best handled by legal experts such as retired judges or magistrates. It will also involve legal precedents and applications that may be beyond the expertise of some members of the original arbitration committee."
On October 31, 2009 the resolution committee requested that a vote be taken by the elders that attended the meeting to form this committee on whether or not their role should be expanded and the overwhelming majority of these voters agreed not to expand the committee’s role. This ended the role of the resolution committee. [It is not clear to me what exactly the resolution committee asked for.]
Calls for binding arbitration
On Sunday November, 1 2009 Omar Tarazi, a local lawyer wrote, ” If anybody files any kind of legal action in court right now it would be very damaging to the whole community.” He reminded the community of the recent attacks against Masjid Noor with the court filings in Florida regarding the Rifqa Bary case. He added that arbitration is “an area that is best handled by a professional. A professional will solve your problems quickly and most importantly it will not go in the newspaper.”
And he proposed: ”On Monday [the next day] both sides can call the big name law firms in town and look for a non-Muslim lawyer who specializes in nonprofit law who also is willing to do an arbitration. Once this person is identified, both sides sign a contract with that individual. Both sides will also turn over all property such as keys, files, and E-mail lists to that individual. That individual will then conduct a professional arbitration hearing all the evidence from both sides.
By the end of the week the individual then makes a decision based on all the evidence regarding who exactly is legally in charge of the organization and he will then turn over to those individuals all of the keys, files, E-mails lists etc.
So by this Friday we can be done with this fight, it will probably take the arbitrator $300 per hour for I would guess 8 hours to do this work. This means a total of $2,400. The cost to each side is $1,200, and we have a final decision regarding who legally is in charge and those people will also have all of the property of the organization.”
The next day Ahmad Al-Akhras wrote:
"I humbly suggest that a group of three Muslim lawyers of the community, may be selected by those on this list --since it seems everybody copies the same names on their emails-- and they put the rules for a binding arbitration. Only then things would move forward. I do not believe other than both parties agreeing to the binding arbitration any solution would be achieved.
Dear brothers and sisters --I believe each and every one of you have a stake in this. Do not let this mess get out to the public, the whole community would suffer for many years to come. Look at EVERY example from around the country, if you go public and to have courts decide, such an act would create a scar that would never go away. "
Omar Tarazi's arbitration framework
Then Omar Tarazi worked tirelessly and quietly away from the public eye for over a month. Many compromises were made, and Tarazi went back and forth repeatedly between both parties in order to reach an arbitration framework that would be acceptable to all. This was not an arbitration, but an effort to hire an outside professional arbitrator and get both sides on board with a common understanding of how the arbitration would be conducted.
On December 7, 2009, Khaled Farag announced the acceptance of his side of the Arbitration Framework as Developed by Attorney Omar Tarazi and added
“ We are now still waiting for Dr. Hany Saqr to commit to arbitration so that we may resolve all disputes, find closure and move forward with the communities work. Unfortunately after initially committing to arbitration within a legal frame work developed by Br. Omar, Hany has continued to make changes and stall the process.
Dr. Hany has continued to drag his feet by asking for revision upon revision and asking for more time to consider proposal after proposal, without sincerely committing to the process. We fear that these tactics are no more than a strategy to extend this conflict and leave the community in a frozen state, while Hany considers his options.
The organization cannot continue to be placed on hold while Hany considers his options. We are making a final appeal to Hany to stop the gamesmanship and political maneuvers so that the proper legal resolution is found and a final determination of the facts is established. Only then can this community start the healing process and initiate the reforms that are desperately needed. “
Then he issued an ultimatum: “Therefore, in an attempt to move forward and protect the community’s good name, and valuable assets, we will give Dr. Hany one more week to commit to this binding arbitration frame work”, “If no commitment has been made by 5:00PM Friday, December 11, 2009, we must move to protect the organization and this community by any legal options that may be available.”
Accepted arbitration frame-work
On December 9, 2009, Saqr and Saleh, after making minor editing to some of the 15 points of Omar Tarazi's arbitration framework and adding a new point asking for a full audit to be conducted in parallel, offered the following, called Saqr Arbitration Framework:
“ 1- All decisions will be made by the neutral non-Muslim lawyer[attorney Richard Pace] acting as a binding arbitrator who will be agreed to by all the parties. The parties agree that the arbitrator is attorney Richard Pace who has 27 years experience and his information is attached below.
2- All parties are free to have their own lawyers assist them or represent them in the arbitration proceedings.
3- All parties will sign a binding arbitration agreement and deliver all property of the organization that is in their personal possession (files, lists, construction contracts, financial records, bank statements, officially documents for board member appointments, etc.) to the arbitrator.
4- The parties will split the cost of the arbitrator.
5- The neutral arbitrator will conduct a binding arbitration trial with the rules based on the Ohio Rules of Civil procedure to determine which member of all disputed parties, one by one, is a legally binding board member of the organization. The neutral arbitrator will make findings of fact regarding disputed factual allegations and make a legal conclusion based on the legal evidence and facts and according to the rule of law, which member of all disputed parties has legal legitimacy to be a board member of the Organization.
6- This means all parties will have the rights of discovery, to present their case, to present witnesses to cross examine other witnesses etc.
7- As part of this trial, members of all disputed parties will have the opportunity to present allegations of specific claims of gross breach of fiduciary duty against any other member of all disputed parties.
8- The neutral arbitrator will conduct a binding arbitration trial with the rules based on the Ohio Rules of Civil procedure and make findings of fact regarding each specific claim of gross breach of fiduciary duty and then make a legal conclusion of whether or not those findings amount, individually or collectively, to a gross breach of fiduciary duty.
9- All hearings will be conducted in public with the arbitrator ensuring that certain confidential information is protected like social security numbers and individuals’ bank account numbers etc.
10- The neutral arbitrator will have the power to remove from power a real board member or determine that a disputed party member is not a legitimate board member, if that member does not cooperate in good faith with the arbitration process.
11- Once the real board is determined, the board members who do not have a determination against them that they grossly breached their fiduciary duty to the organization vote on what to do with the board members who do. If the number of board members who do not have a determination of gross breach of fiduciary duty against them is less than three, then the arbitrator will work with those real board members who do not have a determination against them that they grossly breached their fiduciary duty to the organization to identify and appoint a sufficient number of board members so that there are three board members who do not have a determination against them who can vote on what to do with those who do have that determination against them.
12- The neutral arbitrator will then deliver all property of the organization to the legally valid board.
13- The neutral arbitrator will deliver to all parties a copy of all findings, determinations and decisions which shall also be made available to the Muslim community.
14- The goal is to complete the entire process within one month.
15- The neutral arbitrator will make non-binding recommendations on improvements that could be made to the bylaws.
16- In parallel to the arbitration process, the organization will conduct a full financial audit of all its books, financial records, transactions, receipts, bank statements, etc. Upon conclusion of the audit process if any financial violation(s) were found against one or more of the real board members who do not have a determination against them that they grossly breached their fiduciary duty to the organization, the board membership of those members will be automatically terminated. If the number of real board members then becomes less than three, then the arbitrator will work with the parties to identify and appoint a sufficient number of board members.”
The next day, Farag, Ayoub, Mandourah and Islam announced their acceptance of the above offer made by Saqr and Saleh. Soon after that all disputed members each deposited $500 with Attorney Omar Tarazi to start the process. Unfortunately theses efforts shortly collapsed (we will cover that in a future posting) and the issue headed to court.
My personal thoughts
Had Br. Hany Saqr agreed, from the beginning to a binding arbitration by the above mentioned respected resolution committee of Muslims back in October of 2009, Noor Saga could have been solved six month ago, tens of thousands of dollars in legal fees could have been saved, the present division of the community could have been prevented and hundreds of wasted hours could have been used for the benefit of the community.
I believe the larger Muslim community in general, the 35 or so members of the Noor community committee, and the resolution committee in particular, failed to at least exercise enough pressure on all parties, particularly on Br. Saqr to accept the binding arbitration. Saqr’s request that Farag produce any evidence before Saqr committed to a binding arbitration was illogical, and against the concept of arbitration. In binding arbitration you agree on the arbitrator(s) and the issue(s) to be arbitrated first. Then the arbitrator(s) set up the ground rules for the arbitration and proceeds.
I hope and pray that the larger Muslim community, the Noor community, and the newly appointed AIW board members will do a better job by asking privately and publicly for Br. Saqr to resign. They also need to declare themselves as transitional board members and appoint an independent constitution committee to start the true organizational reform. Otherwise, we the Muslim community in central Ohio, will be repeating the same experiment and expecting a different result!

This is what happens when you have a board consisting of a bunch of self-appointed unaccountable dictators. The moment conflict arise, there is no viable mechanism (like elections) to sort things out in an orderly manner. For ten years this community has tolerated, funded, and heaped praise on this dictatorship, and now everyone acts surprised that it has come to this sorry state. Wake up people! You are partly responsible for this problem. The seed for this crisis was planted ten years ago, when NICC/AIW was set up as an unaccountable organization run by self-appointed dictators, and this community blindly went along.

ReplyDeleteHany Saqr is the consummate dictator.
He is blind to everyone and everything that comes in the way of being in control. He also has nothing to lose. If he did, he would have left, long ago.
The problem is that though pressure is built, the Central Ohio Muslim Community does not have the unity and organizational impetus to carry through.
The Muslim community members do not have the skills or the will to demand the change and make sure that justice and the truth is a priority and not values that we pay lip service to.
Hany Saqr is a dictator, but we do not live in a society where change cannot happen if the community leaders and the community members demanded it peacefully and in a sustained manner.
Hany Saqr is abusing and using this weakness in the community. May Allah help the Muslim Community in Central Ohio see the truth and work towards justice.
Because otherwise cynicism and frustration will reign for the near future and for the next generations.

ReplyDeleteI respectfully disagree. This would have papered over the conflict by simply kicking the can down the road.
From the start, the issue at its core is not so much about personalities or individuals. The problem is much deeper than 2-3 people not getting along. Without minimizing the dictatorial proclivities of the actors involved, the core of the problem is to be found in the NICC/AIW flawed Bylaws. Restoring "peace" between a group of unaccountable self-appointed actors would have amounted to temporarily sweeping the core problem under the rug. In retrospect, and in view of what has happened since then (we still need Hany to go), one can view the failure of arbitration as a blessing.
"Wa `asa an takrahu shayían wahuwa khayrun lakum" (you may (now) dislike something that might ultimately becomes blessing to you)
It is true the issues are not about the "personalities and individuals" and rather about the failure of the organizational system in place, but the responsibility of that failure is with the dictatorial individuals.
ReplyDeleteThe Noor saga also highlights the disunity and lack of will of the Noor community in not being able to tackle the issues once they came up and keep coming up.
If Hany Saqr had agreed to arbitration as suggested, he would have demonstrated that he was a willing player for reconciliation and peace.
The Noor Saga as it has played out has displayed that Hany Saqr is willing to stay put at all costs and this intention has been made crystal clear for those who had doubts.
What remains to be seen is whether the Noor community and its leaders let the New BOD at Noor get away with letting him remain, or they put sustained pressure so that it is the community's voice which is heard and not the dictatorial passions of one man which reigns.
The New BOD at Noor cannot have any legitimacy unless they work for the community's interests and needs.
The Noor community members are those who will gain the most and also lose the most if they do not rise up in a unified and determined way and tackle the problems.
I think it is unfair to blame Hany Saqr for everything. Specially, using the word as a dictator abuser etc. In my opinion, it is act of desperation to corner him. The Jews did to Jimmy Carter recently using same tactics.
ReplyDeleteI think Hany has a story to tell, no one listening and people are trying to shut him up by calling him bad names. We should give him a chance and listen to him. I believe he is a good man and he will do what is good for the community. After all he ran over 50 programs in Masjid Noor. Basically, he worked tirelessly to establish the organisations. We should value his efforts and give him credit when it is due.

I think we are on the same page here. Of course, the ultimate responsibility lies with those individuals (Hany, Khaled, and Amgad). They are the ones who set up and maintained this flawed unaccountable system and installed themselves as dictators. (The community at large is also to be faulted for tolerating this for so long. It only started paying attention when conflict among those actors surfaced.) My point is that the arbitration process was aimed at restoring harmony among those self-appointed dictators, not addressing the rot at the core of the organization. Had it succeeded, it would have simply restored the status quo anti. We would have been back to square one. I suppose that would been acceptable to some people, but this would have amounted to papering over the rot at the core. It is in that sense, and in view of how things played out, that I believe that the failure of the arbitration has turned out to be a blessing. Allahu Akbar!

ReplyDeleteI don't know if you have personally "listened to him". We all listened to him multiple times, and in every time he turned to be a LIAR.
He claimed that there were two boards (NICC vs. AIW) and that the three disputed were NICC only THAT WAS A LIE (he went and registered NICC after that)
He said he fired Khaled because of a cashier check he wrote to himself: LIAR.
He said, if the court allow him back, he will work with all the BOD members: LIAR
He told the community he will work with Khaled to bring peace and move forward: LIAR
Do we want to listen to more of his lies??
While he did a lot of good things, he turned around and burnt everything good he did by acting so unethically and selfishly.
He used people, ubused their trust, lied to their faces, and now he is ducking the critisism.
He has lost all respect and has to leave now and apologize to the community.
I agree with the above post. We have all listened to Hany and have heard his "story". The fact that he refuses to leave and is so desperately holding on to power (no matter how diminished it may be), is Hany's way of speaking very loudly. If you want to listen to him and hear his "story" then just open your eyes, his actions are very clear and are very LOUD! He is telling his "story" each and everyday that he defies the community and insists on staying in some lame duck leadership status. The man should have more respect for himself and his family, this desperation for power is very pitiful! It proves everything that was said about him.

ReplyDeleteHe certainly shares a big chunk of blame -- his role in this saga, his tenacious clinging to power, his legendary hubris, self-importance and haughtiness, etc. But, even if he did nothing wrong, the fact remains that the community has completely lost confidence in him and that his continued presence on the board is an obstacle to moving this organization forward. An honorable person would have resigned a long time ago. It is time for him to go, and if he does not do it on his own volition, he should be shown the door.
What I find particulraly puzzling is that there still people like you who seem to care more about him than the interest of the community at large? Is he more important to you than the future of Noor and the NICC institution? Instead of rallying behind a divisive individual whose continued presence on the board is proving to be toxic, you should be encouraging him to step down.

ReplyDeleteWe need to focus on what is important here, and that is saving NICC. If we turn our backs on it, we are turning our backs on the community. In the 4 years I have been going to NICC, I have only met Hany once. Although the actions of the original board are having a direct impact on all of us as a whole, they have had no direct impact on my desire become closer to Allah and to work with those who share that common goal.
All of previously stated problems and issues certainly need to be worked out in a way that they shouldn't have to be dealt with again, ISA. But in the meantime, we cannot let it detract us from the work we do for the community and individuals. If all of the good people turn their backs and walk away, we are letting the bad guys win. If the good people turn away and refuse to be a part of making things better, we are letting evil win. Although much credit is due to the people who created NICC with their blood, sweat and tears and money, THEY are not NICC, we all are. And if we all run away when things get bad, we are letting Shaytan win.
In the fundraiser we witnessed many pledges made (more than $200,000) with one condition: Dr. Hany go work with the other BOD members and bring peace to the organization.

ReplyDeleteActually it is not unfair to blame Hany Saqr. Desperation happens when you don't know where the source of the problem is. This is NOT the case here.
That is the problem with the Muslim community, we think that the issues are with "personalities and individuals" and THIS is squarely where the faults and responsibility lies.
BUT, defending the source of the problem is naive and what is customary of Muslim cultures. The problems become polarized and between two groups. This is what dictators such as Hany Saqr relish in.
This is also where the community interests and progress is diminished and lost.
So, who benefits? - "The dictator" and his groupies.
We live in a civilized and democratic society, which may not be Islamic, but the rules and ways to make change are done in a sustained, unified and organized manner by community leaders and members.
This system allows the means and ways for the community voice to be heard and for the benefit and progress of the whole community NOT to further someones personal interests and goals.
Let us as Muslims learn that we ARE one ummah and work together for the progress and benefit of that UMMAH not for some personality we want to win in this saga.

If Masjid Al Noor is important then just do what needs to be done. There is a new BOD now. Organization work will move on. We should just keep quiet and have BOD run their business. ReplyDeleteHany's harm has already inflicted the masjid. What is worse is that he wants to restore his legacy by having his groupies speak for him and defend him. If you believe that he means good, and to prove that you care about the community and the center more than your good-at-heart imam, then try convincing him to resign for the sake of the community that he has just divided and ruined.
He is a liability on the new board and they have to realize that if they want the community to start trusting them.
Wait until they hear this from the community in the first public meeting. Or may be they also want to duck critisism by avoiding the community?

I agree with the post before about Dr. Sagr is liability to NICC.
ReplyDeleteThe new board members have to understand that their ligitmacy and credibility depends on distancing themself from Dr Sagr. If they choose to keep defending him and sheltering him, they will be the losers.
I heared they forced Amgad Saleh to resign (they threatend to vote him out if he did not resign). If that is true, the board need to to the same with Dr Sagr. He can still be honorary advisor just like Dr. Saleh now.
Then, the new board should put steps to desolve the board or the community can re-confirm them.
Dr Mubin-uldin made good suggestion on that.
If the new board want to open a NEW page, Dr. Sagr can not be in this new page. He burnt all the bridges with the community.
I hope that they will read this advice.
Everybody talks about the new board as if they are truly independent, neutral people. This is a myth. With all respect to some of them, these were picked by Hani. Some of them were clearly rewarded for supporting him in court (Sadoun, Khoker, Abdulrahman Somali).

Why do these people (the new BOD) want to be associated with Hany at this point is beyond me. Why do they want to lend their good name to keep him on the board? Perhaps there was afterall a little Hany (and Khaled) inside each one of them that has long been struggling to come out and has now revealed itself in all its infamy.

This applies to Khaled, Hany, the new BOD members, and many self-described "learned leaders", who consistently and vehemently rail against and decry dictatorial regimes in their county of origin, only to do the same here and now when the opportunity arises. This is sick sanctimonious hypocrisy. Far from tolerating it, as this community sadly tends to often do, it should be exposed and rejected.

ReplyDeleteAll the more reason to make our voices heard. Let them know that is how you feel. This is a democracy we live in. If we feel there is no legitimacy we need to address the BOD themselves. Let them hear the community opinions and views.
Ask them for the email addresses. That cannot be too difficult.
If this had been the case from the very beginning maybe change would have come sooner, who knows.
Allah (SWT) does not change the condition of people, it comes from within and from ourselves.
We are so far away from understanding leadership and unity. Look at Islamic history. Members of the community went up to their leaders and asked them explanations for many things. They asked and demanded accountability of their leaders (Our Prophet (SAW) and Omar R.A).
We have forgotten the Adab of the Muslim generations in Islamic times or even the modern times skills and will to know what we need to do and where we need to go.
Let us tell the New BOD our demands clearly. How long will it be that the community decides what is good for them NOT what what a dictator who hand picked the BOD decides.
We need to email Hany Saqr as well and ask why he has not resigned when he promised he would.

Why do you think that contacting privately and direcly would be more effective? It is not exactly that they do not know how a large section of this community feels, and those views have been made in-person to many of them already. If those people (the new BOD) genuinely wanted to hear directly from the community, they would have taken the initative to hold a public meeting.

Yes; that's precisely the problem and that will be their own undoing. This (new) board would not be legitimate, any more than the previous self-appointed board was, even if Saqr resign or gets the boot.
In addition to and in support of the petition as well as private and public emails and postings, I propose we organize an in-your-face public protest at least each Friday outside Noor demanding reform and work on sustaining it until the new board relents. An e-mail list and/or blog could be set up to coordinate this.

The people who are creating "Fitnah" again, should fear Allah. It seems like people do not want any peace in the community.

The Quran clearly tells us about accountability and justice. Without this the air will not clear. This has not happened. There needs to be clear accountabilty and justice. Ask yourself has this happened?

Well considering that Hani was a principle actor in the turmoil and upheaval in the Masjid Al Noor saga - how can anyone expect the community to trust that he will not instigate such chaos in the future? Where is the accountability in his promise to resign?

A morally right action is one that produces a good outcome, or consequence and thus peace. That is yet to happen on many fronts.
Peace in the community is for many to have no dissenting voices and no justice and accountability. "Keep your views and opinions to yourself. Keep quiet, don't disturb."
Insha'Allah peace will come to the community when the community is a vital and prominent player in all affairs. That has not happened yet. Insha'Allah it will.

ReplyDeleteObviously, you are not hearing the voice of the community. Have a public meeting at NICC, and hear how many will be asking for Hani's resignation. He lied to their faces many times, and caused this huge fitnah.
To pretend that the "new board" has nothing to do with Hani's wrong doings is an insult for the community's intellegence.
As long as the new board keeps sheltering such a divisive figure, they will never win the trust of the community, no matter how qualified they are.
It is about fairness, justice, and doing what is right for the sake of the community - not for the sake for the one person who has picked them up to be his groupies.
I live in the community and I talk to a lot of people at Masjid and around Masjid. Most of their opinion is that they have been lobyed by 2 individuals against Hani.

The 80 community members out of 50 thousand Muslims in this community, is not a big sample.
ReplyDeleteHow many members of this community know the history of Masjid Al Noor? from the land to lawsuit of the land for commission to construction of NICC to the American Flag on this Masjid to the extreme efforts to pull the Muslims to donate then to filing a 'Restraining order' to keep Hani out, then to Khaled being thrown out of AIW.

ReplyDeleteFifty thousand people do not come to Noor. The concerned community is only Noor community. Hardly 8-10 thousand people attend Eid prayers twice a year. On a good Friday, there are 1200-1500 people in the masjid. The existing petition has the signatures of all major leaders of that community. These are well informed, sincere people. There is a hard copy of signed petition in rotation too. The numbers of signatures from that copy still have to be revealed.
A fair way to judge this would be to have another petition launched by Hany's supporters requesting him to stay on board and see how many people from Noor community do sign on it. We will know clearly who has how much support?
But the question that follows it is the question of eligibility and legitimacy of the "New Board." Can we say that the "New Board" will be legitimate and Hany Saqr will be eligible for Imamat, if more people sign petition in their favor? I don't think so. The only way to conclude this is by Islamic law.
This is where the Islamic philosophy of governance and leadership and the western philosophy of democracy differ from each other. Nobody becomes eligible to lead prayers by majority votes. They become imam by passing the criteria to be an imam. There are clear guidelines in Quran and Sunnah for who can be an Imam to lead prayers and an Ameer to lead an Islamic institute.
Petitions are only a way to show consensuses of people's demand in an organized way. It's a civilized and legal way to exert pressure on certain individuals and groups. Petitions alone cannot deliver the justice in our case; they can only help us seeking the justice, inshaAllah. And that's why they are very important.
The responsibility of educating our community is upon our shoulder. Ignorance of community does not mean that the community is not intelligent enough to make right decision once it is educated.
I believe, it's always best to admit our mistakes and clean our mess as early as possible. I think, it's better to open the can of worm and get rid of them before they become dragons.

We can do that by cleaning the mess, opening a new page, and injecting some accountability into the affairs of the Masjid. It is people like you who insist on ignoring the problem or are in denial, that are dividing this community.
I do not think there is a mess anymore. Things are calm and people seems to come back to Masjid and donating for the sake of Allah without condition. The Juma' prayers are full again. The new BOD seems to do a good job.

Umm, pardon my ignorance, but where can I get a copy of Hani's resume? I'm assuming since he's a community leader and imam then his qualifications should be public record, no? I'm wondering how and where exactly he became an imam? Thank you.
ReplyDeleteAlso, I'm wondering how exactly was khaled farag 'exonerated'? He was both the lending and recieving party so he could have cooked the books? Not to say that he did of course, but what was the method used to exonerate him other than looking at the books and seeing the numbers (that HE wrote down himself). If you think abt it there's really no way of knowing what was happening with the bookkeeping because HE was in charge of the checks and balances. I just think we need to clarify that point so there are no doubts in peoples minds.

The people who pointed this information out and brought it to the community - Khaled Farag, Mufakkarul Islam, Hassan Ayoub and Ashraf Mandourah) have since resigned.
From the two instigators of Hani Saqr and Amgad Saleh - Amgad Saleh has also been forced to resign.
Hani Saqr though he has blatantly misled and deceived the community since this fitnah began is still hanging onto the vestiges of power. It maybe that he sees that he is on a mission or it maybe that he has nothing else to do.
It is obvious that the handpicked BOD are unable or lack the backbone to get him to resign.
The community should consider the points given below:
1. This community is being tested by Allah(SWT) and how we respond and deal with the issues is crucial.
2. The community needs to realize that unless change is brought about, we will be in stagnation.
3. The community needs to be inclusive and encompassing of all its members. This has not happened yet.
4. Unity of purpose for the greater cause needs to be established and made the talking point.
5. Success and peace is from Allah.
They tried to bring their case to the community, but unfortunately, the communities lack of will and unity means
